PrizePay Code Redemption Terms & Conditions

These terms and conditions apply to persons claiming prizes via the PrizePay website at https://prizepay.com.au (Site) and must be read in conjunction with the general terms of use of the Site at www.prizepay.com.au/general-terms (General Terms). The General Terms, together with these terms and conditions, form the terms and conditions for prize claimants of the Site (collectively, PrizePay Code Redemption Terms). Any capitalised terms in these terms and conditions which are defined in the General Terms, have the meaning given in the General Terms.

By accessing and using the Site you hereby agree to the PrizePay Code Redemption Terms. If you do not agree to the PrizePay Code Redemption Terms, do not create an account with, claim a prize through, or otherwise access, the Site.

1. Prize Redemptions

1. We provide a service through our Site which allows the winner of a competition conducted by one of our third party clients (Trade Promotion) to redeem their prize using a unique prize code (PrizePay Code) via the Site (Prize Redemption).
2. In order to complete a Prize Redemption, you must be at least 18 years old. For a Prize Redemption of a funds transfer, you must also hold an Australian bank account.
3. You are responsible for maintaining the confidentiality of any PrizePay Code provided to you. You will be solely responsible for any unauthorised access to, or use of, your PrizePay Codes.
4. A Prize Redemption may provide you with access to a prize provided a third party (Prize).
5. PrizePay is merely a platform to provide you with access to Prizes and unless expressly stated otherwise, Prizes are not provided by us.
6. You acknowledge and agree that:
   1. all Trade Promotions and Prizes are subject to their own terms and conditions;
   2. we are not a party to, or liable (including for any loss, special, indirect or consequential loss, damage or injury, loss of claim, costs incurred or paid) with respect to your dealings with any third parties in relation to a Prize or a Trade Promotion
   3. we are not liable for any act, omission or negligence or any other party, including in respect of the security and privacy of information provided by you to a third party;
   4. we reserve the right to vary, cancel or remove access to our services, including Prize Redemptions, at any time at our sole discretion, with no notice to you; and
   5. Eligibility for a Prize Redemption cannot be transferred.

2. Dealings with Third Parties

1. 1. You may, through the Site, view third party advertisements and other general information (Third Party Advertisements) supplied by third parties including those that provide Prizes or that we otherwise have affiliations with (Third Parties).
   2. You acknowledge and agree that:
      1. we do not guarantee the completeness, accuracy, currency or reliability of Third Party Advertisements or Prizes. You must make your own investigation into the accuracy of Third Party Advertisements. For example, we do not warrant that:
         1. any Third Party has the legal authority to sell or provide a product or service, including any Prize; or
         2. any Prize, including any a product or service described in a Third Party Advertisement is actually in existence;
      2. any communications entered into between you and a Third Party are done at your own risk;
      3. any transactions resulting from use of the Site will be with a Third Party directly, and will be completely independent from PrizePay;
      4. PrizePay provides a platform only to connect you with Third Parties for the purpose of redeeming Prizes from those Third Parties, and is not responsible for any negotiations or disputes arising as the result of a Prize, and is not in any way in partnership or otherwise associated with you or any Third Party;
      5. PrizePay is not a party to any arrangement between the you and a Third Party. As a result, we have no control over, and do not ensure, guarantee or provide any warranty or indemnity in respect of the quality, fitness for purpose, legality, accuracy, completeness or otherwise of;
         1. any goods or services offered to you by a Third Party;
         2. any information provided by Third Parties, including in a Third Party Advertisement;
         3. the ability of the parties to undertake their respective obligations; or;
         4. prices charged by a Third Party to you;
      6. PrizePay does not have any knowledge of products or services relating to Third Party Advertisements or Prizes and therefore we are not responsible for providing advice in respect of them. It is your sole responsibility to ensure that goods or services are suitable for their intended purpose and information provided by a Third Party is correct;
      7. PrizePay takes no responsibility for any Third Party complying with any applicable laws;
      8. PrizePay strongly encourages you to conduct enquiries to ensure that information displayed on a Third Party Advertisement is accurate; and;
      9. PrizePay is not responsible for any loss or damage experienced by you in the event that a Prize is inaccurately described in a Third Party Advertisement or is misleading.;

3. Third Party Terms

1. Any Prize received as a result of a Prize Redemption is subject to any applicable terms and conditions as implemented by the Third Party provider from time to time, which may include, but is not limited to the:
   1. Prezzee eGift Card Terms of Service (available at https://www.prezzee.com.au/policies/terms-of-service) and Prezzee eGift Card Terms of Sale (available at https://www.prezzee.com.au/policies/terms-of-sale) for any Prezzee eGift Cards; and
   2. Azupay Product Disclsoure Statement (available at https://azupay.com.au/wp-content/uploads/2024/04/Azupay-PDS.pdf) for any cash payments or transfer of funds, (collectively, Prize Conditions).
2. By completing a Prize Redemption, you acknowledge and agree that you have read and accept the Prize Conditions applicable to your selected Prize.
